Built for Businesses
Wauto AI is a business-to-business (B2B) SaaS platform intended for businesses, freelancers, and entrepreneurs operating in India. It is not intended for personal, family, or consumer use. By signing up — whether on the website or through the mobile app — you confirm that you are using the service for legitimate business workflows (customer engagement, lead handling, support automation) in compliance with WhatsApp's and Meta's commerce + business policies.
1. Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you and Wauto AI ("Wauto", "we", "us") and govern your use of the Wauto AI website at wauto.ai, the Wauto AI mobile applications on iOS and Android, and any related dashboards, APIs, or services (together, the "Service"). By creating an account, installing the app, or otherwise accessing the Service, you agree to be bound by these Terms, the Privacy Policy, all applicable laws and regulations, and any policies referenced below.
If you do not agree with any part of these Terms, you must not access or use the Service.
2. Description of the Service
Wauto AI provides a WhatsApp customer-engagement automation platform with optional AI chat replies and AI voice calling. The Service is delivered as a hosted SaaS product and is accessed via the web dashboard and the official Wauto AI mobile apps. Features available to your account depend on the subscription plan you select.
3. Eligibility & Account Registration
To use the Service you must (a) be at least 18 years old, (b) be using the account for legitimate business workflows, and (c) provide accurate information at sign-up. A GSTIN (Goods and Services Tax Identification Number) is optional at registration — small businesses, freelancers, and pre-GST-registration entrepreneurs may sign up without one. If you provide a GSTIN, you represent that it is genuinely owned by you or your authorised organisation. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us promptly at info@wauto.ai if you suspect unauthorised access.
4. Subscriptions & Auto-Renewal
Certain features of the Service are offered on a subscription basis. The available subscription plans, their duration (e.g. one month, one year) and their price are displayed inside the app and on the website before you confirm purchase. By starting a subscription you agree to the following:
- Auto-renewal. Subscriptions renew automatically for successive periods of the same length at the same price until cancelled. Renewal occurs within 24 hours before the end of the current period.
- Billing. Subscriptions purchased through the iOS app are billed to your Apple ID; subscriptions purchased through the website are billed via Razorpay or another payment processor we list at checkout.
- Price changes. If we change the price of a subscription, the new price will apply starting from the next renewal cycle after we notify you, in accordance with Apple's rules where applicable.
- Free trials & introductory offers. If a free trial or introductory price is offered, the trial converts to a paid subscription at the end of the trial period unless you cancel before then. Only one trial per Apple ID is permitted by Apple.
5. In-App Purchases (Apple App Store)
Subscriptions purchased through the Wauto AI iOS app are processed by Apple Inc. under Apple's standard in-app purchase terms. Apple — not Wauto AI — is the merchant of record for these purchases. By purchasing an iOS subscription you also agree to Apple's Standard EULA and Apple's Media Services Terms, in addition to these Terms. To the extent there is a conflict between these Terms and Apple's terms with respect to iOS in-app purchases, Apple's terms control as to the payment, refund and account-level matters that Apple administers.
6. Cancellation & Refunds
- iOS subscriptions. You can cancel your subscription at any time by going to Settings → [your name] → Subscriptions on your iOS device, selecting Wauto AI, and tapping Cancel. Cancellation takes effect at the end of the current billing period, and you keep access until that period ends. Refund requests for iOS subscriptions must be made to Apple at reportaproblem.apple.com — refunds for iOS in-app purchases are at Apple's discretion under their policies.
- Website subscriptions. You can cancel a website subscription at any time from your dashboard at app.wauto.ai under Profile → Subscriptions. Cancellation takes effect at the end of the current billing period. Refunds for website subscriptions are considered on a case-by-case basis; contact us at info@wauto.ai within 7 days of the most recent charge.
7. Use License
Subject to your continued compliance with these Terms and payment of any applicable subscription fees, Wauto AI grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the internal business purposes of the organisation that owns the account. All rights not expressly granted are reserved.
8. WhatsApp Service Usage
Users must comply with the WhatsApp Business Policy, WhatsApp Commerce Policy and WhatsApp Terms of Service. Wauto AI is a third-party automation tool and is not responsible for any account suspensions, number bans or message rate-limits that result from violations of WhatsApp's policies — including, without limitation, unsolicited messaging, spamming, sending content prohibited by Meta, or scraping contacts.
9. Acceptable Use
You agree not to, and not to allow any third party using your account to:
- Send unsolicited bulk messages, spam, phishing content, or messages that violate any law or any third-party platform's policies.
- Use the Service to harass, defraud, deceive, or harm any person.
- Upload knowledge base content that you do not have the right to use, or that infringes any intellectual-property right.
- Reverse-engineer, decompile or attempt to derive the source code of the Service except to the extent that applicable law expressly permits.
- Resell, sublicense, or rent the Service to a third party without our written consent.
We may suspend or terminate accounts that violate this section, with or without notice, as required to protect the Service and other users.
10. Intellectual Property
The Service, including all software, models, designs, trademarks and content (other than your knowledge base and customer data, which remain yours), is owned by Wauto AI or its licensors and is protected by Indian and international intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Wauto AI makes no warranties, express or implied, and disclaims all implied warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated replies will be accurate in every situation; you are responsible for reviewing critical messages before they are sent.
12. Limitation of Liability
To the maximum extent permitted by law, Wauto AI's total aggregate liability for any claims arising out of or related to the Service is limited to the amounts paid by you to Wauto AI in the twelve (12) months preceding the event giving rise to the claim. In no event will Wauto AI be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost data or business interruption, even if advised of the possibility of such damages.
13. Apple-Specific Terms (iOS Users)
The following clauses apply to your use of the Wauto AI iOS app, in addition to all other Terms. They exist because Apple's Developer Program License Agreement (Schedule 2) requires custom EULAs to include them.
- These Terms are an agreement between you and Wauto AI only, and not with Apple. Apple is not responsible for the Wauto AI app or its content.
- Your licence to use the Wauto AI iOS app is limited to a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms.
- Apple has no obligation to provide maintenance or support services for the Wauto AI iOS app. Any maintenance or support is the sole responsibility of Wauto AI.
- If the Wauto AI iOS app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Wauto AI.
- Wauto AI, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
- In the event of any third-party claim that the app or your possession or use of it infringes that third party's intellectual-property rights, Wauto AI — not Apple — will be solely responsible for the investigation, defence, settlement and discharge of such claim.
- You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the Wauto AI iOS app (for example, your wireless data services agreement).
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms with respect to the Wauto AI iOS app, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
14. Termination
You may stop using the Service and delete your account at any time from the dashboard or, on iOS, by submitting an account-deletion request from inside the app. We may suspend or terminate access to the Service if you materially breach these Terms, if required by law, or if continuing the Service would expose us or other users to unreasonable risk. On termination, your right to use the Service ends; provisions that by their nature should survive termination (including Sections 10–13) will survive.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. The courts located in Mumbai, Maharashtra will have exclusive jurisdiction over any dispute arising out of or related to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date below and, where the change is material, notify you by email or through the app or dashboard. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them.
